Distance Sales Agreement

1. Parties
This agreement is concluded between, on one side, the SELLER [Company Name] (MERSİS: [●], Tax No: [●], Address: [●], E-mail: destek@coachni.com) and, on the other side, the BUYER / CONSUMER who purchases the service. It is concluded on the following terms upon the BUYER purchasing a subscription electronically through the coachni app or coachni.com.
2. Subject
The subject of this agreement is the sale and performance of the digital subscription service ordered electronically by the BUYER, whose characteristics and price are stated on the purchase screen (training/nutrition planning, progress tracking, AI-powered analysis, coach–athlete communication). The provisions of Turkish Law No. 6502 and the Regulation on Distance Contracts apply.
3. Service and Price
- The subscription type, duration and price including VAT are shown on the purchase screen.
- Payment is collected through the app store or an integrated payment institution; card details are not stored by the SELLER.
- Unless cancelled, the subscription may renew automatically at the end of the period at the current price.
4. Performance and Delivery
The service is digital and, following payment confirmation, becomes accessible in the BUYER's account immediately; there is no physical delivery. Access to the service is provided through the app for the duration of the subscription.
5. Right of Withdrawal
For digital services whose performance has begun with the express consent of the BUYER and which are performed instantly in the electronic environment, there may be no right of withdrawal under Art. 15/1-ğ of the Regulation on Distance Contracts. 6. Buyer's Obligations
The BUYER is obliged to use their account and the service in accordance with this agreement, the Terms of Use, and applicable legislation. coachni is not a medical service; plans and analyses are advisory in nature.
7. Personal Data
The principles governing the processing of personal data are set out in the KVKK Privacy Notice and the Privacy Policy.
8. Disputes and Jurisdiction
In disputes, the Consumer Arbitration Committees and Consumer Courts at the BUYER's place of residence have jurisdiction, within the monetary limits announced by the Ministry of Customs and Trade.
9. Entry into Force
The agreement enters into force when the BUYER reads and electronically approves this agreement and the Preliminary Information Form on the purchase screen.
